1. Who we are and what these terms cover

These Terms and Conditions ("Terms") govern your use of nutritionninjasa.com ("the Website") and the purchase of any meal plan, trial, or related product or service from Plated Preps (Pty) Ltd, trading as Nutrition Ninja ("Nutrition Ninja", "we", "us", "our").

By placing an order, submitting our signup form, or accepting these Terms at checkout, you enter into a binding agreement with us. If you do not agree to these Terms, do not place an order.

These Terms must be read together with our Refund and Cancellation Policy and our Privacy Policy, both of which form part of this agreement.

2. Your capacity to contract

You warrant that you are at least 18 years of age and legally capable of entering into a binding contract. If you order on behalf of another person, you warrant that you have their authority to do so and that you have accurately disclosed their dietary requirements, allergies, and medical conditions to us.

3. VAT status and pricing

Nutrition Ninja is not a registered VAT vendor. All prices displayed on the Website are final prices in South African Rand (ZAR). No VAT is charged and no VAT invoice will be issued.

Prices exclude delivery unless expressly stated. Current delivery fees per 28-day cycle:

ZoneFee
SandtonR310
Fourways / Cedar / DainfernR360
Midrand / SunninghillR410

We reserve the right to correct pricing errors on the Website at any time, including after an order is placed but before it is fulfilled. Where a price is corrected after payment, we will notify you and you may elect to proceed at the corrected price or receive a full refund of that order.

4. Subscription structure

4.1 Cycles

Meal plans operate on a rolling 28-day subscription cycle. Each cycle is paid in advance and renews automatically for a further 28-day cycle unless cancelled in accordance with clause 5 or our Refund and Cancellation Policy.

4.2 Payment

Payment is collected in advance of each cycle by way of an invoice issued through our accounting system and settled via PayFast (Payfast (Pty) Ltd), our third-party payment processor. Your card and payment details are handled by PayFast and are never stored by us.

Your place in the production schedule is confirmed only once payment reflects. Unpaid invoices result in suspension of the next cycle without further notice.

4.3 Kitchen capacity

Our kitchen operates on a fixed weekly capacity. Places in the production schedule are limited and are allocated to paying subscribers on a continuing basis. Where a subscription is cancelled or lapses for non-payment, that place is released and may be allocated to another client. We cannot guarantee that a place will be available should you wish to rejoin.

4.4 Price changes

We may amend subscription prices, delivery fees, or plan structures on 30 days' written notice to the email address on your account. Continued use of the service after the notice period constitutes acceptance of the amended pricing. If you do not accept the change, you may cancel in accordance with our Refund and Cancellation Policy before the change takes effect.

5. Taste Test trial

The Taste Test is a 5-day trial with no subscription and no auto-renewal. It is a once-off purchase, available once per household, and does not convert into a subscription unless you separately place a subscription order. Trial orders are subject to these Terms in full, including the allergen provisions in clause 8.

6. Menu, meals, and substitutions

6.1 Rotation

Our menu rotates weekly. The published menu is indicative. We reserve the right to substitute ingredients, components, or entire dishes without prior notice where supply, quality, seasonality, or food safety requires it. Substitutions will remain within the calorie and protein band of your selected tier.

6.2 Macros and nutritional information

Calorie and macronutrient figures are calculated estimates based on standardised ingredient data and target plating weights. Natural variation in raw ingredients, cooking loss, and portioning tolerance means actual values may vary. Figures are provided for guidance and are not a warranty of exact nutritional content.

6.3 Not medical or dietetic advice

Nutrition Ninja provides prepared food. Nothing on the Website, in our communications, or in any meal plan constitutes medical, dietetic, or clinical advice, and no practitioner-patient relationship is created. Our meals are not designed to treat, diagnose, cure, or prevent any disease or condition.

If you are pregnant or breastfeeding, have a medical condition, are taking medication, or are under medical or dietetic supervision, consult your healthcare practitioner before starting any meal plan. You use our service at your own election and remain responsible for your own health decisions.

6.4 Results

We make no representation, guarantee, or warranty as to weight loss, body composition, athletic performance, or any other outcome. Results depend on factors outside our control, including your total dietary intake, training, sleep, genetics, and medical status.

7. Fresh food, storage, and shelf life

Our meals are fresh and never frozen. They contain no preservatives beyond those naturally present in the ingredients.

You must:

  • refrigerate meals at or below 4 °C immediately on receipt;
  • consume each meal by the "use by" date printed on its label;
  • reheat thoroughly to a core temperature of at least 75 °C before eating;
  • never refreeze a meal that has been delivered chilled.

Our responsibility for the safety and quality of a meal ends at the point of delivery. We accept no liability for illness, spoilage, or deterioration arising from improper storage, delayed refrigeration, consumption after the use-by date, inadequate reheating, or any handling of the product after it leaves our control.

8. Allergens — your obligations and our limits

This clause is important. Read it in full.

8.1 Shared kitchen — no allergen-free guarantee

All Nutrition Ninja meals are prepared in a single shared kitchen that handles, among others: milk and dairy, eggs, wheat and gluten-containing cereals, soya, peanuts, tree nuts, sesame, fish, crustaceans, molluscs, mustard, celery, sulphites, lupin, and legumes including chickpeas and beans.

We are allergen-aware, not allergen-free. Despite reasonable cleaning, separation, and handling controls, we cannot and do not guarantee that any meal is free from any allergen, or free from cross-contact with any allergen. No meal, label, or communication from us should be treated as a guarantee of the absence of an allergen.

If you have a severe, anaphylactic, or life-threatening allergy, do not order from us. We are not able to safely serve you.

8.2 Your disclosure obligation

You must fully and accurately disclose all allergies, intolerances, and dietary restrictions — for yourself and for any person you order on behalf of — at signup, and you must notify us in writing of any change before the start of the next cycle.

We rely entirely on the information you provide. We do not screen, verify, or independently assess your allergen profile. An incomplete, inaccurate, or out-of-date disclosure is your responsibility, and we accept no liability for any consequence arising from it.

8.3 Order blocking

Where an allergen profile is unconfirmed, ambiguous, or incomplete, we will block the order and will not produce or dispatch meals until the profile is confirmed in writing. Any delay to your delivery arising from this is not a breach by us and does not entitle you to a refund, credit, or replacement.

8.4 No silent substitution

We do not silently substitute ingredients to accommodate a declared allergen. Where an allergen cannot be safely accommodated within a dish, we will substitute the meal, or flag it to you, or decline the order. Declared hard-block allergens are excluded from the dish entirely rather than swapped.

8.5 Check every label

Menus rotate weekly and ingredients change. You must read the ingredient and allergen information on every individual meal label before consuming it, on every delivery, regardless of what you have received previously. Reliance on a previous week's meal composition is at your own risk.

8.6 Limitation

To the fullest extent permitted by law, we accept no liability for any allergic reaction, intolerance response, adverse reaction, injury, loss, or damage arising from:

  • any allergen you did not disclose, or disclosed inaccurately or incompletely;
  • any change to your allergen profile not notified to us in writing before the relevant cycle;
  • cross-contact in a shared production environment;
  • your failure to read the label supplied with each meal;
  • your consumption of a meal ordered for or supplied to another person.

9. Delivery

9.1 Schedule

Deliveries are made on scheduled delivery days communicated to you in advance. We do not commit to a specific delivery time or time window. Delivery days may be adjusted for public holidays, load shedding, vehicle failure, weather, or other operational requirements, and we will notify you where reasonably possible.

9.2 Your address and access

You are responsible for supplying a complete and accurate delivery address, and for ensuring safe and lawful access for our driver at the delivery address on scheduled delivery days — including estate access, gate codes, complex authorisation, security clearance, and the presence of a person able to receive the delivery.

9.3 Failed delivery

Where a delivery cannot be completed because no one is available to receive it, access is refused or unavailable, the address supplied is incorrect or incomplete, or the driver is unable to safely reach the address, the meals for that delivery are forfeited. No refund, credit, replacement, or carry-forward will be given.

Where you instruct us to leave a delivery unattended, or a delivery is accepted by a third party at your address, risk and responsibility pass to you at the moment of that delivery. We are not responsible for meals left unrefrigerated, taken by another person, or spoiled thereafter.

9.4 Risk

Risk in the meals passes to you on delivery.

10. Away days and travel

Where you notify us in writing before the applicable ordering cut-off that you will be away, the affected meals will be made up on your return within the same 28-day subscription cycle. Meals not made up within the cycle in which they were paid for lapse and are not carried forward, refunded, or credited. See the Refund and Cancellation Policy for full detail.

11. Quality issues and reporting window

If a meal is damaged, incorrect, short-delivered, or does not meet a reasonable standard, you must notify us in writing at admin@nutritionninjasa.com or on WhatsApp within 24 hours of delivery, with a clear photograph of the meal and its label.

Claims made outside this window, or without photographic evidence, cannot be investigated and will not be accepted. This is a condition of any remedy, not a formality.

Where a claim is upheld, our sole remedy at our election is a replacement meal on the next scheduled delivery or a credit to your account. See the Refund and Cancellation Policy.

12. Your account and communications

You must keep your contact details, delivery address, and allergen profile current. Notices from us are validly given when sent to the email address or WhatsApp number on your account. You consent to receiving service-related communications, including delivery notifications, invoices, menu updates, and renewal notices, by email and WhatsApp.

13. Acceptable use

You may not resell, redistribute, or commercially exploit our meals. You may not misuse the Website, attempt to gain unauthorised access to our systems, or submit false information. We may suspend or terminate any subscription, without refund of the unused balance of a cycle, where you breach these Terms, abuse our staff, or engage in fraudulent conduct.

14. Intellectual property

All content on the Website — including recipes, menu descriptions, photography, brand names, logos, the Nutrition Ninja name and marks, and the site design — is owned by or licensed to Plated Preps (Pty) Ltd and may not be copied, reproduced, or used without our prior written consent.

15. Limitation of liability

To the fullest extent permitted by South African law, and subject always to your rights under the Consumer Protection Act, 68 of 2008:

  • our total aggregate liability to you arising out of or in connection with these Terms, howsoever arising, is limited to the amount you paid us for the subscription cycle in which the claim arose;
  • we are not liable for any indirect, incidental, special, punitive, or consequential loss, including loss of income, loss of profit, loss of opportunity, or loss of data;
  • we are not liable for any failure or delay in performance caused by events beyond our reasonable control, including load shedding, water interruption, supplier failure, strike action, civil unrest, extreme weather, vehicle breakdown, road closure, epidemic, or an act of state.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our gross negligence, or liability under section 61 of the Consumer Protection Act.

16. Indemnity

You indemnify and hold harmless Plated Preps (Pty) Ltd, its directors, employees, and contractors against any claim, loss, damage, or expense arising from your breach of these Terms, your failure to disclose an allergy or medical condition accurately and completely, your handling or storage of meals after delivery, or your supply of our meals to any third party.

17. Electronic communications and consumer rights

This agreement is concluded electronically in terms of the Electronic Communications and Transactions Act, 25 of 2002 ("ECTA").

You acknowledge that the 7-day cooling-off right in section 44 of ECTA does not apply to our meals, as it excludes goods made to the consumer's specifications, goods that are perishable by nature, and foodstuffs.

Your rights under the Consumer Protection Act, 68 of 2008, including any right to cancel a fixed-term agreement on notice, are not excluded by these Terms and operate alongside our Refund and Cancellation Policy. Where a statutory right conflicts with a provision of these Terms, the statutory right prevails to the extent of the conflict.

18. Privacy and data

Your personal information, including allergen and dietary information, is processed in accordance with our Privacy Policy and the Protection of Personal Information Act, 4 of 2013 ("POPIA").

19. Changes to these Terms

We may amend these Terms from time to time. The version published on the Website at the time you place an order governs that order. Material changes affecting active subscribers will be notified by email at least 30 days before taking effect.

20. Severability, whole agreement, and governing law

If any provision of these Terms is found unenforceable, it is severed and the remaining provisions continue in full force.

These Terms, together with the Refund and Cancellation Policy and the Privacy Policy, constitute the entire agreement between you and us. No representation, warranty, or undertaking not recorded in writing here is binding on us. No indulgence granted by us constitutes a waiver of any right.

These Terms are governed by the laws of the Republic of South Africa. The parties consent to the jurisdiction of the Magistrate's Court having jurisdiction, notwithstanding that a claim may exceed that court's monetary limits.
